Clients had an umbrella policy which included $1,000,000 of underinsured motorist coverage. Dempsey and Kingsland arranged for a functional capacity evaluation which confirmed that RC had sustained permanent injury which prevented her from returning to work. Dempsey and Kingsland made demand on the defendant’s insurance carrier and client’s carrier for the full policy limits of each policy.
