  • $43.1 Million Vaccine Leads to Paralysis/Quadriplegia

    It is believed that this case is the single largest recovery for an individual for a vaccine injury in the United States. The case arises from a devastating adverse reaction to the measles, mumps & rubella (MMR) vaccine administered at a local pediatric clinic in Kansas City, Missouri To the then one (1) year old child.

  • $7.32 Million Vaccine Leads to Cardiac/Respiratory Arrest & Brain Damage

    This case arises out of a devastating adverse reaction by a Missouri resident to the tetanus, diphtheria, pertussis (Tdap) vaccine. This vaccine had been administered to the then fifty-eight (58) year old financial planner who had formerly served as mayor of the small community where she lived. The plaintiff sustained encephalopathy and profound, irreversible brain injury.

  • $7.25 Million Workers' Compensation

    $7.25 million was awarded to the family of a twenty-five-year-old worker who fell to his death from a high rise building. The young man left behind a wife and three daughters. The worker was untrained and inexperienced and was in his first hour on the job when he was caused to fall to his death. This case was litigated in Jackson County.

  • $7 Million Breach of Policy Coverage/Bad Faith Claim
    In this case, an insurer failed to pay its policy limits thus exposing its insured to liability well beyond that sum. A $7 million settlement was eventually reached for the death of a young man. The underlying claim centered upon the insurer’s refusal to pay its $1 million in coverage. The settlement demand was repeatedly renewed but the carrier repeatedly refused to pay. After a Judgment well in excess of its coverage limits against its insured, a bad faith case ensued.
  • $5 Million Truck-Car Fatality Collision

    The insurance company for the truck driver and trucking company defendants initially offered $375,000 to settle this case. After we filed suit and took depositions of the truck driver and the President of the trucking company and its Safety Director, the defendants requested a mediation that accomplished a settlement in the sum of $5,000,000. Missouri Lawyers Weekly cited this case as the 5th largest settlement in the state of Missouri in 2008.

  • $4 Million Head-On Collision

    Our client sustained multiple, serious injuries from a head-on collision that happened on the highway in Southeast Kansas. We settled this case without needing to file suit after we obtained a life care plan from a certified life care planner who itemized and priced all of the future care needs of the client.

  • $2.69 Million Elective Surgery Fraud/Malpractice

    A local Kansas City surgeon committed fraud when he advertised on the local television station that he was performing a new and improved elective surgery procedure right here in the Kansas City area that would change his patients’ lives forever. Previously this new and revolutionary elective procedure was only being performed in locations distant from Kansas City.

    On the morning following the news segment, the surgeon’s phone was ringing off the hook as countless patients in the Kansas City area called into his office as soon as they could because they were so excited about the new wonderful procedure. The surgeon received so many calls after his airing on the local news that his elective surgery practice quadrupled within one week.

    The horrible truth was that this surgeon was not performing the new procedure he promised and never had any training or experience at all in the new and revolutionary surgery he advertised. Instead this surgeon was performing a dangerous and unrecognized variation of a much older and abandoned elective surgery procedure upon his patients.

    Dempsey and Kingsland, P.C. represented several Plaintiffs who were repeatedly hospitalized and were permanently damaged as a result of this surgeon’s fraudulent conduct. The team at Dempsey and Kingsland, P.C. did a thorough investigation into these patients injuries and discovered this surgeon’s fraud; the fact that he was not performing the surgery that he represented to his patients on the local news and then again misrepresented to his patients in consultations causing their catastrophic injuries.   • $2.3 Million Bariatric Surgeries

    Several patients underwent what they believed was a new type of bariatric surgery previously available only in distant locations and at great cost. But, instead the surgery offered was an old and relatively dated surgery seldom offered due to a variety of reasons. This group of plaintiffs suffered an array of surgical complications in the months and years following their surgeries. Cumulatively, these cases settled at $2.3 million. All were litigated in the conservative jurisdiction of Johnson County, Kansas.

  • $1.85 Million Worker Crushed by Forklift at Industrial Plant

    A middle aged worker was horribly crushed by a forklift while visiting an industrial plant. His orthopedic fractures were magnified by terrible internal injuries.

  • $1.83 Million Vaccine Leads to Spinal Injury

    A Kansas City area resident was awarded $1.83 million after she developed transverse myelitis within 24 hours of receiving a flu vaccine. The patient lived and worked with her husband in good health until she received a flu shot at her annual physical exam. The following morning, she experienced severe sensory loss and numbness in both legs and feet. Her husband rushed her to the hospital where doctors diagnosed her with transverse myelitis – a neurological disorder caused by inflammation of a segment of the spinal cord.

    The Defendant’s expert contended that the numbness R.M. experienced in her lower extremities was due to a spinal cord infarct and could not have been caused by her flu vaccine. Defendant’s expert relied heavily on medical literature demonstrating that the typical onset window for transverse myelitis is five to 42 days after administration of a flu vaccine. After hearing testimony from Plaintiff’s causation expert, the court agreed with Plaintiff that, although rare, the onset of transverse myelitis can occur within 24 hours. After testimony that the Plaintiff had never experienced any symptoms of numbness, the court found that the flu vaccine was the likely cause of her injury.

    With causation resolved in favor of the Plaintiff, both parties where able to agree on a life care plan upon which the $1.83 million dollar settlement was based on. The settlement takes into account the fact that the patient had experience a limited partial recovery, but still suffers numbness, lacks stamina, and will likely never be able to resume her previous physical activities.
